AVDC and BCC: not playing by the rules

Aylesbury Vale District Council have produced a 256-page legal submission to object to the application by local residents to register Daly Way Green as a ‘town green’. In a new twist, it has emerged that AVDC’s submission was A WEEK LATE.

The closing date for objections made to Bucks County Council was 1 July 2008 – click the images below to see the public notice (posted at Daly Way Green) and the newspaper notice (published in the Bucks Herald). The AVDC objection paperwork is clearly dated 8 July 2008 (click image for a closer look). No notification of any deadline extension was given to residents – so it is reasonable to assume the 1 July deadline should stand.





Residents formally requested that Bucks County Council should disregard the AVDC objection because late submission made it invalid. BCC have immediately rejected this request on the basis that they are willing to accept objections - even after the deadline!

Local residents are left feeling angry and bemused – not only has the District Council defied common sense by objecting to the protection of a popular local amenity space, but now the County Council seems to be bending the rules. In the meantime, Thames Water remain very quiet – but the campaign to Save Daly Way Green continues.

Well, you couldn't make it up. Sometimes I don't know whether to laugh or cry.

I've just been trying to explain to my 7-year-old why the local councils won't protect the green she loves playing on. She repeated her simple question over and over again: WHY?

I didn't have the answer - but the faceless bureaucrats from AVDC and BCC are welcome to come round to my house anytime to give their answer...

I can't beleive our councils can behave in such a bullying and high handed way. 1st the attitude of Thames Water, and now of AVDC and BCC towards us seems to be that we deserve to be treated with contempt, just because we are daring to fight for this green. It just makes me feel like selling up and moving a long way away - but I can't of course, because thanks to this cloud hanging over us, my home is unsaleable at the moment!
So much for encouraging people to come and live in Aylesbury, when all these new homes are built - I just want to tell anyone who is thinking of it: DON'T! It's crap here and the councils don't actually mean a word of all their green policies and promises. They just trample all over ordinary people.

How sad our tax money being wasted in this way, no wonder my property tax keeps increasing above inflation.
Between their gold plated council pensions, exorbitant salaries (AVDC actually boasted about its high salary structure for executives in a nationwide recruitment article recently), and this type of wasted effort, the residents are on a hiding to nothing.

It borders on criminal that our local council sees fit to try to block residents attempts to protect in law their leisure environment, when they themselves can't be bothered, or don't want to.
What a state this country is in, no wonder people are apathetic and cynical about local government.

It seems due dates and deadlines don't apply if you are a council, you do what you want and to hell with the tax payer !!!!

I say again;
A little common sense in AVDC would go a long way.
They already agree and are party to a covenant protecting the land, what sense does it make for them to spend our money objecting to a logical application by residents to formalize the protection in law by registering the area as town green.
Come on lets get some common sense going in AVDC and quit the obstructive expensive b*l*hit

Disgraceful behaviour from Council Officers, we have a poorly led and managed Council who lack decisiveness and direction.

I for one have no confidence in their abilities to run and manage effectively Council business.

A complete waste of hard earned tax payers money, officers responsible for this waste should be removed from their positions.

The Chief Executive, Chairman, Directors and Leaders of AVDC should be totally ashamed of their actions, their positions are untenable and they should be dismissed.

I call for a vote of no confidence from residents and local tax payers.

So AVDC think that their is no need to register the green as Town Green as they say it is already adequately protected due to it having been designated "Open Space" and it also has the protection of a Covenant which restricts development.

Was it not AVDC planning officers who recommended acceptance of Thames Waters development proposals

Have they not also stated that the Covenant is irrelevant as Thames Water could compulsorily purchase the land and that this would override the rights and interests and covenants affecting the land.

Do they not have policies which are supposed to protect and enhance our green spaces.

The only sensible way forward as residents have concluded would be to register the Green as Town Green.

AVDC - Withdraw your objection and voluntarily register this green as Town Green. As requested by residents over 12 months ago and supported with a petition containing over 250 signattures

AVDC - You can not have it both ways, either you are committed to your policies of protecting greens like this or you are not.
Your actions so far send out the clear message and state that you are not committed to your policies.

Double standards, say one thing and do another, get off the fence, be decisive and act positively.

These documents, produced by barristers normally cost about £1000 per page.

That amounts to £250,000 of tax payers money wasted by AVDC in an effort to prevent themselves implementing their own policies.

Just when you thought it could not get any worse, AVDC come along and clearly demonstrate where their loyalties lie.

This has been a stitch up from the start and AVDC have lied about their position

One year, and still waiting for response/action by AVDC on residents requests to voluntarily register the green.

Funny how in one month they can suddenly manage to put together for BCC a 250+ page objection to residents attempts.

An example of our thinking , caring council looking after the local resident tax payer ??

I hope all councilors will take note of this huge waste by officers of AVDC!
